1. Acceptance of Terms

By accessing, browsing, or using the FundingAlphaX website, platform, or any associated services (collectively, the “Services”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms”). If you do not agree with any part of these Terms, you must not use our Services.

These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and FundingAlphaX (“Company,” “we,” “us,” or “our”). By creating an account or purchasing any challenge, you confirm your acceptance of these Terms in their entirety.

You further acknowledge that these Terms incorporate by reference our Privacy Policy, Refund Policy, Risk Disclosure, AML Policy, and Cookie Policy, each of which forms an integral part of these Terms.

2. Eligibility

To use our Services, you must:

  • Be at least 18 years of age or the age of majority in your jurisdiction, whichever is greater.
  • Have the legal capacity to enter into a binding agreement.
  • Not be a resident or citizen of any jurisdiction where our Services are restricted or prohibited by applicable law, including but not limited to sanctioned countries as designated by OFAC, the European Union, or the United Nations.
  • Provide accurate, current, and complete information during registration and maintain the accuracy of such information.
  • Not be subject to any trade or economic sanctions imposed by any government authority.

FundingAlphaX reserves the right to refuse service, terminate accounts, or cancel orders at its sole discretion if eligibility requirements are not met. No refund or compensation shall be provided in such cases.

3. Account Creation and Security

When you create an account with FundingAlphaX, you are responsible for maintaining the confidentiality of your account credentials, including your password and any associated authentication methods. You agree to:

  • Create only one account per individual. Multiple accounts are strictly prohibited and may result in immediate termination of all accounts without refund or compensation.
  • Not share your account credentials with any third party.
  • Notify us immediately of any unauthorized access to or use of your account.
  • Accept full responsibility for all activities that occur under your account, whether or not authorized by you.

We utilize Google OAuth for authentication services. By using our platform, you also agree to Google's terms of service and privacy policy as they relate to authentication and identity management. FundingAlphaX is not responsible for any failures, outages, or security incidents originating from Google's authentication infrastructure.

4. Challenge Rules and Funded Account Terms

FundingAlphaX offers evaluation challenges (“Challenges”) that allow traders to demonstrate their skills in a simulated trading environment. Upon successful completion of a Challenge, qualified traders may receive access to a funded trading account.

4.1 Challenge Parameters

Each Challenge has specific rules, including but not limited to profit targets, maximum drawdown limits, daily loss limits, minimum trading days, and restricted trading practices. These parameters are displayed on your dashboard and in the challenge rules section of the platform. You are solely responsible for understanding and adhering to all applicable rules.

4.2 Funded Account Terms

Funded accounts are simulated trading accounts provided to traders who successfully complete the evaluation process. Profit splits, payout schedules, and scaling plans are determined by the specific challenge tier and are subject to change. FundingAlphaX reserves the right to modify funded account terms with reasonable notice.

4.3 Prohibited Trading Practices

The following activities are strictly prohibited and may result in immediate account termination without refund or compensation:

  • Use of any form of exploitative trading, including latency arbitrage, toxic order flow, or platform manipulation.
  • Copy trading from another FundingAlphaX account or coordinating trades across multiple accounts.
  • Use of third-party automated trading bots or expert advisors unless explicitly permitted.
  • Any form of hedging across multiple FundingAlphaX accounts.
  • Intentional exploitation of platform errors, data feed issues, or pricing discrepancies.
  • Attempting to reverse-engineer, decompile, or interfere with the platform's trading engine or pricing mechanisms.
  • Using VPNs, proxies, or other tools to circumvent geographic restrictions or platform security measures.

4.4 Platform Authority

FundingAlphaX reserves the absolute and sole right to halt, restrict, or suspend trading activity across the platform at any time, for any reason, including but not limited to market volatility, system maintenance, third-party API disruptions, or security incidents. No refund, credit, or compensation shall be owed in connection with any trading halt or restriction.

5. Payment Terms

5.1 Challenge Fees

Challenge fees are one-time payments required to access a trading evaluation. All prices are displayed in USD equivalent. We accept cryptocurrency payments exclusively through our designated third-party payment processor.

5.2 Third-Party Payment Processing (NOWPayments)

All cryptocurrency payments on FundingAlphaX are processed by NOWPayments, a third-party payment gateway. By making a payment, you acknowledge and agree that:

  • FundingAlphaX does not directly process, hold, custody, or manage any cryptocurrency funds during the payment process.
  • NOWPayments is an independent third-party service provider and is solely responsible for the processing, confirmation, and settlement of your payment transactions.
  • FundingAlphaX bears no liability whatsoever for any payment failures, delays, errors, lost funds, incorrect exchange rates, network congestion, blockchain confirmation failures, or any other issues arising from the use of NOWPayments or the underlying blockchain networks.
  • Any dispute regarding payment processing, exchange rates, or transaction failures must be directed to NOWPayments. FundingAlphaX will not mediate, arbitrate, or adjudicate payment processing disputes.
  • Cryptocurrency payments are processed at the exchange rate determined by NOWPayments at the time of the transaction. FundingAlphaX has no control over and accepts no responsibility for exchange rate fluctuations.
  • Once a cryptocurrency transaction is broadcast to the blockchain, it is irreversible. FundingAlphaX cannot reverse, cancel, or modify any blockchain transaction under any circumstances.
  • You are solely responsible for ensuring the correct payment amount is sent to the correct wallet address. Payments sent to incorrect addresses, on incorrect networks, or in incorrect denominations are permanently lost, and FundingAlphaX bears no responsibility for such losses.

5.3 Absolute No-Refund Policy

ALL FEES PAID TO FUNDINGALPHAX ARE FINAL, NON-REFUNDABLE, AND NON-TRANSFERABLE UNDER ALL CIRCUMSTANCES. There are no exceptions to this policy. Please review our Refund Policy for complete details.

By purchasing any challenge or service, you expressly acknowledge and agree that you are making a final, irrevocable payment and that you waive any and all rights to request a refund, chargeback, reversal, or credit under any circumstances whatsoever, including but not limited to dissatisfaction with the service, failure to pass a challenge, platform downtime, third-party service disruptions, or any other reason.

6. Third-Party Services and API Providers

FundingAlphaX relies on independent third-party services and application programming interfaces (APIs) to deliver key aspects of the platform. By using our Services, you acknowledge and agree to the following:

6.1 Market Data and Trading Execution (Binance)

Our simulated trading environment utilizes real-time market data and price feeds obtained from Binance via their public APIs. You acknowledge that:

  • Binance is an independent third-party service provider and FundingAlphaX has no control over, and accepts no responsibility for, the accuracy, availability, timeliness, or reliability of Binance's market data, API endpoints, or infrastructure.
  • Any inaccuracies, delays, interruptions, or outages in Binance's data feeds may directly affect price displays, order execution, simulated profit/loss calculations, drawdown computations, and challenge pass/fail determinations on the FundingAlphaX platform.
  • FundingAlphaX shall bear absolutely no liability for any losses, missed trades, erroneous fills, incorrect profit/loss calculations, wrongful challenge failures, or any other adverse outcomes resulting from Binance API failures, rate-limiting, data inaccuracies, or service disruptions.
  • You assume all risk associated with trading decisions made based on market data obtained from third-party providers.

6.2 Charting and Technical Analysis (TradingView)

FundingAlphaX integrates TradingView widgets and charting tools to provide visual market data and technical analysis capabilities. You acknowledge that:

  • TradingView is an independent third-party service provider and FundingAlphaX has no control over their charting data, widgets, or infrastructure.
  • FundingAlphaX bears no liability whatsoever for any inaccuracies in TradingView's charting data, indicator calculations, or visual representations that may influence your trading decisions.
  • TradingView service outages, loading failures, or display errors are beyond FundingAlphaX's control and do not constitute a basis for any claim, refund, or compensation.

6.3 General Third-Party Disclaimer

FUNDINGALPHAX EXPRESSLY DISCLAIMS ALL LIABILITY FOR ANY AND ALL LOSSES, DAMAGES, COSTS, OR EXPENSES — WHETHER DIRECT, INDIRECT, CONSEQUENTIAL, INCIDENTAL, OR PUNITIVE — ARISING FROM OR RELATED TO THE FAILURE, MALFUNCTION, INACCURACY, UNAVAILABILITY, OR DISCONTINUATION OF ANY THIRD-PARTY SERVICE, API, DATA PROVIDER, PAYMENT PROCESSOR, OR INFRASTRUCTURE PROVIDER USED BY OR INTEGRATED INTO THE FUNDINGALPHAX PLATFORM.

Third-party services referenced in these Terms include, but are not limited to: NOWPayments (payment processing), Binance (market data and price feeds), TradingView (charting and market overview data), Google (authentication and identity management), and any hosting, CDN, database, or cloud infrastructure providers.

You acknowledge that any issue, outage, failure, error, or disruption caused by any third-party service provider is entirely outside of FundingAlphaX's control and that FundingAlphaX shall not be held responsible, liable, or accountable for any consequences arising therefrom.

7. Simulated Trading Disclaimer

All trading conducted on the FundingAlphaX platform, including during Challenges and on funded accounts, occurs in a simulated trading environment. No real financial instruments are bought, sold, or exchanged. The simulated environment is designed to replicate real-market conditions but may differ from live market execution.

FundingAlphaX does not provide brokerage services, investment advice, or asset management services. Payouts to funded traders are based on simulated performance metrics and are paid as independent contractor compensation, not investment returns.

The simulated trading environment depends on third-party data feeds and APIs. Discrepancies between simulated execution and actual market conditions — including price differences, execution speeds, slippage, spread variations, and liquidity constraints — are inherent to simulated trading and do not constitute a defect in our Services.

8. Intellectual Property

All content, features, and functionality on the FundingAlphaX platform — including but not limited to text, graphics, logos, icons, images, audio clips, data compilations, software, and the compilation thereof — are the exclusive property of FundingAlphaX or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any materials from our platform without prior written consent, except as permitted for personal, non-commercial use.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FUNDINGALPHAX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, BUSINESS OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Services, regardless of the cause.
  • Any unauthorized access to or alteration of your transmissions or data.
  • Any third-party conduct on the Services, including actions of other traders.
  • Platform downtime, technical issues, server failures, or data feed interruptions, whether caused by FundingAlphaX or any third-party provider.
  • Any trading losses incurred in simulated or funded accounts, regardless of the cause.
  • Failures, outages, errors, or inaccuracies of third-party APIs, including but not limited to Binance, TradingView, NOWPayments, or Google.
  • Cryptocurrency payment failures, delays, lost transactions, or incorrect exchange rates processed by NOWPayments or any blockchain network.
  • Incorrect, delayed, or missing market data provided by Binance or any other data feed provider.
  • Any decisions you make based on information, charts, or data displayed on the platform.
  • Force majeure events, including but not limited to natural disasters, acts of war, terrorism, pandemics, government actions, regulatory changes, internet infrastructure failures, or blockchain network congestion.

IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF FUNDINGALPHAX FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES EXCEED THE LESSER OF (A) THE AMOUNT YOU PAID TO FUNDINGALPHAX IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100.00).

YOU ACKNOWLEDGE THAT THE LIMITATIONS SET FORTH IN THIS SECTION ARE FUNDAMENTAL ELEMENTS OF THE BARGAIN BETWEEN YOU AND FUNDINGALPHAX, AND THAT FUNDINGALPHAX WOULD NOT PROVIDE THE SERVICES WITHOUT SUCH LIMITATIONS.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. FUNDINGALPHAX EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

FUNDINGALPHAX DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. FUNDINGALPHAX DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY MARKET DATA, PRICE FEEDS, OR INFORMATION DISPLAYED ON THE PLATFORM.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM FUNDINGALPHAX OR THROUGH THE SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

11. Indemnification

You agree to indemnify, defend, and hold harmless FundingAlphaX, its officers, directors, employees, agents, affiliates, licensors, and service providers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to:

  • Your violation of these Terms or any applicable rules or policies.
  • Your use or misuse of the Services.
  • Your violation of any rights of any third party.
  • Any dispute between you and a third-party service provider (including NOWPayments, Binance, or TradingView).
  • Any claim arising from your trading activity or decisions on the platform.
  • Any chargeback, payment dispute, or fraudulent payment initiated by you or on your behalf.

This indemnification obligation shall survive the termination of your account and these Terms.

12. Termination

FundingAlphaX reserves the right to suspend or terminate your account and access to the Services at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to:

  • Violation of these Terms or any applicable rules.
  • Engaging in prohibited trading practices.
  • Fraudulent or deceptive conduct.
  • Failure to comply with identity verification or KYC requirements.
  • Extended inactivity (90 days or more without trading activity).
  • Initiating a chargeback or unauthorized payment dispute.
  • Engaging in any activity that, in our sole judgment, is harmful to our business, reputation, or other users.

Upon termination, your right to use the Services will immediately cease. No refunds, credits, or compensation of any kind shall be provided upon termination, regardless of the reason. Any pending payouts shall be forfeited if termination is due to a Terms violation, fraudulent activity, or prohibited conduct.

13. Force Majeure

FundingAlphaX shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from any cause beyond our reasonable control, including but not limited to:

  • Natural disasters, epidemics, pandemics, or acts of God.
  • War, terrorism, civil unrest, or government actions.
  • Regulatory or legislative changes affecting cryptocurrency, trading, or financial services.
  • Failures, outages, or disruptions of third-party service providers, including NOWPayments, Binance, TradingView, Google, hosting providers, or internet infrastructure.
  • Blockchain network congestion, hard forks, protocol changes, or smart contract failures.
  • Power outages, internet outages, or telecommunications failures.
  • Cyberattacks, DDoS attacks, or security breaches affecting FundingAlphaX or its service providers.

During any force majeure event, FundingAlphaX's obligations shall be suspended for the duration of the event. No refund, credit, or compensation shall be provided for any disruption caused by a force majeure event.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FundingAlphaX is incorporated, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within thirty (30) days, it shall be submitted to binding arbitration in accordance with the rules of the applicable arbitration body. You agree to waive any right to participate in a class action lawsuit, class-wide arbitration, or any form of collective or representative action.

You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

15. Severability

If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect. The unenforceable provision shall be replaced by an enforceable provision that most closely reflects the intent of the original provision.

16. Entire Agreement

These Terms, together with the Privacy Policy, Refund Policy, Risk Disclosure, AML Policy, and Cookie Policy, constitute the entire agreement between you and FundingAlphaX regarding the use of the Services and supersede all prior and contemporaneous agreements, representations, and understandings, whether oral or written.

17. Changes to Terms

FundingAlphaX reserves the right to modify or replace these Terms at any time at its sole discretion. Material changes will be communicated via email notification or a prominent notice on the platform at least fourteen (14) days before the changes take effect.

Your continued use of the Services following the posting of revised Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must discontinue use of the Services. No refund shall be provided if you choose to discontinue use following a Terms update.
